On September 1, 2024, the General Department of Customs and Excise (GDCE) of Cambodia has launched the Intellectual Property Rights Recordation System (IPRRS). The new system allows the IP right holders to input related information and documentations with the customs authorities, facilitating faster and more effective actions by the authorities at border control. The system is still at pilot stage but is fully functional at present.
Currently, there are two types of recordation:
- Intellectual Property recordation: Trademarks, geographical Indications and copyrights could be recorded. Required information such as applicant’s identity, contact information, IPR information, details on how to distinguish the genuine goods and counterfeiting goods as well as related documents such as IPR registration certificate need to be docketed into the system.
- Exclusive Distributorship recordation: This recordation is to escort the process after the Ministry of Commerce issues the notice of recordation of exclusive distributorship. Before IPRRS is introduced, GDCE manually enters information into their records which usually causes some delay. With the new IPRRS, it is expected to provide faster access to the necessary information as the exclusive distributors/legal representatives could enter the information into the system by themselves. It is expected to help facilitate identification of parallel imports at the border.
The recordation process is expected to be within two business days. The recordation will be valid for the term of IPR or notice of recordation of exclusive distributorship. If the IPR or notice of recordation of exclusive distributorship is renewed, the new recordation at IPRRS is required.
The new system is available online through the trader portal of GDCE’s website – https://trader.customs.gov.kh.
